Martin Zee – Guard Merseyrail
Further to Head Office Circular NP/188/16, 18th July 2016, I am writing to update you on developments with this matter. A trial date had been set for 26th July 2016 but it was not until three days before the trial was due to commence that RMT were informed that the case had been ‘vacated’. A trial is ‘vacated’ when one or both sides are not fully prepared for the trial. A new trial date has been set for March 2017. Further details of the new date will be circulated closer to the time.
Separately to these events two resolutions on this matter were submitted to the AGM:
AGM 57: called on the union to approach Train Operating Companies in the event of a guilty verdict in the case, demanding a halt to current self-despatch and door operating procedures.
ER3; called for a ballot of all our safety critical members in the event of a guilty verdict in the case.
These two resolutions have now been considered by the National Executive Committee and the following reports of their Health and Safety Subcommittee have been noted and adopted by the NEC.
AGM 57:
That we note the resolution and instruct the GS to link this file to the main file “Brother Martin Zee Guard Merseyrail” (HSR/2/11).

That we note the contents of the resolution and instruct the GS to place this matter back before us following the outcome of the court case.
