Dear Colleague,

TfL: DEFEND JOBS, PENSIONS & AGREEMENTS – STATION STAFFING ISSUES AND MINIMUM NUMBERS

Further to Head Office Circular NP/9/23, dated 13th January 2023, at its meeting on 14th February 2023, your National Executive Committee (NEC) noted and adopted the following report from its Health and Safety sub-committee, having considered the legal advice provided:

We note the legal opinion on file.

The General Secretary is instructed to write to LUL registering a Failure to Agree, providing detail as to how LUL has failed to comply with its obligations (drawing upon some of the obligations set out in the legal advice provided), challenging LUL’s self-fulfilling determination that it can avoid the CAP because it adjudges the risks not to be “significant”.

The General Secretary is further instructed to write to ORR on this matter.

This matter to be placed back before this NEC following any response from LUL or other developments.

Relevant Branches and Regional Councils to be informed.

I am acting in line with these instructions.

Please bring the contents of this circular to the attention of relevant members.

Yours sincerely

Michael Lynch

General Secretary
