INSTRUCTION TO MEMBERS NOT TO ROUTE LEARN IS CANCELLED

In my communication to you dated 21st July 2016 you were advised as follows:-

Members are instructed not to undertake any route learning for routes other than those normally learnt by Conductors and Conductor Instructors at their depot from:-

•    0001 Thursday 28th July 2016 until further notice.

This instruction has been rescinded and members should undertake route learning if instructed to do so by management.

The union received a challenge from the company, obviously written by their lawyers, in which they used the anti-trade union laws to question the legality of our instruction to members.

For your information, as at this time it is only Conductors at Selhurst who would be taking this industrial action not to route learn and so we cannot in our notice to the company list all the other Southern Depots. Even though our members in the other depots would not be taking action, the very fact of listing those depots makes our notice legally questionable. Whilst it would have no impact on the dispute, no detrimental effect to the company or the running of trains, the law is set down in such a way as to ensure unions can be challenged on technicalities.

It is disgraceful that Southern, instead of trying to resolve this dispute went running to their lawyers to see if they could find manipulate the anti-unions laws to their advantage. Regrettably the advice from our own lawyers is that it would be better and safer to cancel this part of our strategy. It was our lawyer’s view that the chances of an injunction being granted were high.

I am sorry that I need to write to you with this instruction but whilst the RMT has been very successful in defending its members against this very punitive and unfair legislation we have not done so on this occasion.

However, rest assured the fight continues and the National Executive Committee will give this matter further consideration tomorrow. I will of course keep you informed of developments.
