BREACH OF THE COLLECTIVE BARGAINING AGREEMENT – CROSS COUNTRY

 

I write with regards to the above matter and to inform you that the RMT are in dispute with Cross Country as a result of management holding negotiations outside the Collective Bargaining Agreement and imposing changes to companywide agreements without the involvement of the RMT.

 

The issues of dispute which must be resolved are as follows: •Breach of the Collective Bargaining Agreement by imposition of a fundamental change to the Flexible Working Policy. •Breach of the Collective Bargaining Agreement by refusal to recognise RMT to represent Driver grades. •Breach of the Collective Bargaining Agreement by negotiating changes to companywide Disciplinary Procedures without the involvement of the RMT.

This situation not only shows a total disregard to a principled process but undermines recognised Trade Unions. Therefore, the union’s National Executive Committee has consulted with your Union Representatives and after careful consideration believes the situation has become intolerable and there is no other choice but to ballot you and your colleagues for industrial action.

 

The ballot for strike action and industrial action short of a strike will open on Monday 20th May 2019 and your voting paper will be sent to your home address shortly after this date. If you have not received your voting paper by Tuesday 28th May 2019 please contact the RMT Helpline on 0800 376 3706 or Head Office on 0207 387 4771 and ask for the Industrial Relations Department, where a replacement voting paper will be sent out.

 

Please make sure you use your vote and vote YES to both questions when you receive your ballot paper. It is imperative that we get a massive return in the ballot for industrial action so we are not prevented from acting on members’ wishes by the new ballot thresholds.
