BULLYING & HARASSMENT, METROPOLITAN LINE SOUTH COVER GROUP LONDON UNDERGROUND
Following a resolution received from Neasden Branch and a report from your Lead Officer, the National Executive Committee has considered the issues concerning RMT members Brother Mahoney, Brother Glasstone and Rep Brother Rollinger, and has taken the decision to enter a dispute situation with the Company and ballot CSM, CSS & CSA members at Baker Street Area for strike action and industrial action short of a strike.
Brother Elia Mahoney was sacked under the LUL probation procedure despite serving more than 10 months in work. Bro Mahoney’s initial probation period included a 100% attendance rule and the probation was extended to 9 months after one item of sickness. However, after 10 months service he was called to a ‘probation review’ and sacked. The dismissal letter refers to events that occurred after the 9 month probation period was complete and his appeal against the dismissal has been refused.
Brother Peter Glasstone correctly pointed out to management that only a supervisory grade or manager can conduct station familiarisation and was then suspended for refusing an instruction to work on another station area. Although he is now back at work, he is facing a disciplinary hearing on charges of breaching the LUL code of conduct and refusing an instruction which in itself was a breach of the Stations Framework Agreement.
Brother Laszlo Rollinger, a local RMT Industrial Representative, produced a report after a level one meeting on the group and a complaint of a minor nature from a manager regarding this report is being treated as a formal Harassment and Bullying issue with external investigators appointed at significant cost. However when members have made legitimate and serious complaints they are told their issues do not meet the criteria for a Harassment & Bullying investigation. It is clear that the complaint against Bro Rollinger has been escalated to a formal H&B investigation because it relates to his duties as a recognised RMT Representative and there is one rule for them and one rule for us.
Your Functional Council Reps have made efforts on various occasions to discuss each case with management but the response from LUL has been belligerent at best. The Company has refused to reinstate Bro Mahoney, to drop the disciplinary action against Bro Glasstone or deal informally with the complaint against Bro Rollinger. This overbearing behavior against RMT Reps and members cannot be allowed to continue and we demand that all procedures and policies are applied equally and fairly to all.
