DEFECTIVE DESTINATION BOARDS – STAGECOACH EAST MIDLANDS
I am writing to provide you with an update on the above matter after concerns were raised that members feared prosecution over taking buses out that had defective destination boards.
As I advised you previously, I wrote to the company demanding that the practise of members taking such buses out into service should cease until the legal position is clarified. I also outlined to the company that failure to address the concerns of you and your colleagues would result in a ballot for industrial action commencing.
I can advise you that I have now received a response from Stagecoach East Midlands which states that it has raised this matter with the DVSA to ensure clarity for all concerned. A verbal assurance was obtained from the local DVSA Traffic Examiner that no action would be taken against the driver if the screen were to fail. Written confirmation has now been requested and this remains outstanding.
The matter was also raised with the Senior Traffic Commissioner, who again did not see this as being a driver-related offence.
