DISMISSAL, C MARGERISON – STADLER RAIL (MERSEYRAIL CONTRACT)

I am writing further to my letter of 28th May 2021, where I had congratulated members on their magnificent support for Brother Chris Margerison who has been dismissed, a disciplinary sanction that is grossly disproportionate and overly harsh.

For those of you who have not taken industrial action before, please let me be crystal clear: any member who follows the union’s instructions for industrial action are automatically protected from dismissal in doing so. This applies to any of your colleagues in the affected grades and workplaces who decide to join the union and were not involved in the ballot. Because a lawful ballot has been conducted members are legally protected. If you are dismissed for taking part in the industrial action as instructed you will be considered to have been automatically unfairly dismissed. It does not matter how long you have been employed, or when you become an RMT member.

Talks have taken place at the highest level between your union and Stadler, and having discussed the issue with the Managing Director, no agreeable resolution to the dispute has been tabled. Your union is always available for talks in any dispute but in this instance no settlement has been possible.

Therefore, I urge all members to support the industrial action and follow the instructions below. Encourage your colleagues to join the union. If they are in the affected grades and workplaces, they too can participate in the industrial action without fear of dismissal for doing so. We need to stand together and demonstrate our unity in the face of the unfair treatment of Brother Margerison.

All members substantively employed as Maintenance Team Supervisor, Technician Grade 1, Technician Grade 2 and Workshop Assistant 2 at Liverpool Kirkdale Depot and Birkenhead North Maintenance Depot are instructed not to book on for any shifts that commence between: -

00.01 hours and 23.59 hours on Monday 14th June 2021.

Furthermore, members are instructed to take industrial action short of a strike in the form of a Rest Day working and Overtime ban from: -

00.01 hours on Tuesday 15th June 2021 until further notice.

I will, of course, keep members updated on all developments in this regard.
