Dear Colleagues,

DISMISSAL, C MARGERISON – STADLER RAIL (MERSEYRAIL CONTRACT)

The decision by Stadler to sack Chris Margerison following a first disciplinary offence and in consideration of his loyalty and commitment to the Company is outrageous. The severity of the punishment for an error in clocking-in to work is out of step with the incident and could set a dangerous precedent for other members at Stadler Rail.

The Company’s refusal to hear a case put for Brother Margerison means that there is no alternative to balloting members in defence of Chris. Your union is always prepared to enter talks with an employer to resolve a situation, but management have made their stance clear: they have committed to sack an employee and are not prepared to listen to any reasonable points that could be put to them.

The approach employed by the Company towards Brother Margerison in this matter is obviously a tragedy for Chris who has been dismissed having previously demonstrated his commitment to the job. Further to this, the approach of management in reaching this outcome is concerning in the precedent it sets for all members following a disciplinary matter.

Your NEC has considered the matter and noting the view of your Lead Officer and Representatives, has taken the decision to ballot members for industrial action as the only avenue available to ensure that this injustice is put right.

Ballot papers are being despatched today. Therefore, your ballot paper should hit your doormat in the next few days. It goes without saying that as soon as you receive your ballot paper you should do everything in your power to make sure it is returned to the independent scrutineer and you should encourage all RMT members in your workplace to use their vote.

I am urging you all to vote 'YES' to both questions in the ballot for industrial action. It is vital we receive a huge 'YES' vote so we can continue the fight for Brother Margerison’s reinstatement. If the statutory thresholds are not met, then no industrial action can happen - even if members vote overwhelmingly 'yes' for both strike action and action short of a strike. Therefore, IF YOU DON'T VOTE - IT COUNTS AS A 'NO' VOTE. We cannot allow Stadler to win and use the draconian anti-trade union laws in this dispute.
