DISMISSAL, GARY CARNEY, TRAIN OPERATOR – LONDON UNDERGROUND

Our Ref LUL/4/1

25th February 2021

TO ALL LONDON UNDERGROUND TRAIN OPERATORS AND OPERATOR INSTRUCTORS ON THE CENTRAL LINE

Dear Colleagues,

DISMISSAL, GARY CARNEY, TRAIN OPERATOR – LONDON UNDERGROUND

Following the outrageous decision of London Underground to dismiss one of our members and Reps on completely unjustified grounds a meeting was convened on Friday 19th February of your LUL Train Operator representatives, Lead Officer, SAGS and National Executive Committee to consider our options.

The meeting follows your union entering into dispute with LUL on the grounds that the dismissal of Brother Carney is unfair and completely out of step with the facts of the matter. LUL allege that Gary Carney sought to avoid a random drug and alcohol test despite accepting that he was taken ill, vomited and subsequently had booked-off work on grounds of sickness before being made aware of LUL’s intention to conduct the test. In addition to this an investigating manager has made an issue of Brother Carney being a trade union representative in the course of the investigation.

At Friday’s meeting it was made clear that our Reps and members are determined to defend Gary Carney and seek his reinstatement given the grossly unjustified grounds for his dismissal. Resolutions have also been received from both the Central Line East Branch and the Central Line West Branch calling for action to be taken to defend Brother Carney and seek their reinstatement.

Your NEC has considered the matter following Friday’s meeting and in line with the views of our Train Operator Reps the decision was taken to instruct me to conduct a ballot of all Central Line Traincrew Depots for industrial action in the form of a strike for Brother Carney’s reinstatement.

I urge our members to update their membership details, especially if they have moved house, grade or depot. If any of your details has recently changed, then please contact the RMT Helpline by Email at info@rmt.org.uk. Alternatively, members can call the RMT Freephone Helpline number on 0800 376 3706.

As a union we are determined that this terrible injustice is addressed and put right by our member being reinstated to their substantive role. LUL should not have dismissed Gary and it is vital that we defend a representative with a twenty year unblemished service in the absence of any real justification for their dismissal.

I trust this keeps you fully advised and I will update you on all further developments.

Yours sincerely

Mick Cash
