DISMISSAL, V EDERARO – MTR ELIZABETH LINE
I write with regards to the above matter and to inform you that I have received the following resolution from our Paddington No 1 Branch:
“Paddington No.1 Branch are shocked to hear that Bro. Victor Ederaro had his dismissal from MTR Elizabeth Line upheld at appeal stage following the use of a disputed redeployment process. We find this to be wholly unacceptable given the use of an un-agreed process to render a Branch and Union member unemployed, as well as the fact that the member was not given any reasonable adjustments, despite his occupational health report stating that mitigations should be provided.
Following Circular No: IR/193/24 on the 21st of June 2024 where it was stated that the National Executive Committee had instructed you to write to the company ensuring that they put an end to the use of this policy and ensure that members affected by the non-agreed redeployment parameters receive full monies lost between their dismissal and reinstatement, we echo the East London Rail branch’s astonishment that the company have chosen not to reinstate Bro. Ederaro to his role.
Further to the East London Rail Branch letter dated 4th October which calls for a ballot for industrial action over the dismissal of Bro Victor Ederaro and the continued use of a disputed redeployment process, Paddington No.1 calls on the NEC to demand that a fit for purpose redeployment policy is implemented in consultation with the Union, ensuring that this does not happen to any members in future. Paddington No.1 also requests a ballot for industrial action for all recognised Customer Experience grades in the Central Operating Section of the Elizabeth Line if Bro. Ederaro is not reinstated immediately and reimbursed of all loses suffered since his dismissal.”
The matter has been subject to recent consideration by the union’s National Executive Committee who note the resolution from our Paddington No 1 Branch and thank them for it.
The Executive Committee are appalled to hear that our member, Brother Victor Ederaro’s dismissal was upheld at the Appeal stage. This is wholly unacceptable, given the use of a non-agreed process and the fact that our member was not given any reasonable adjustments, despite clear recommendations in the Occupational Health report stating that he should be given some.
Therefore, the Executive Committee has instructed me to seek a Directors Review of our members case and to prepare a ballot matrix of our Customer Experience Assistant (CEA), Customer Experience Sales Assistant (CESA) and Station Control Room Operator (SCRO) grade members in the Central Operating Section (COS) of MTR Elizabeth Line.
The Executive Committee has also instructed to demand that a fit-for-purpose Redeployment policy be implemented in consultation with the Union, ensuring that this does not happen to any RMT members in the future.
I am now acting on the instructions of the NEC decision and I will, of course, keep you fully advised any further developments.
