LOSS OF PAY/ANNUAL LEAVE, STATION CLOSURE – RAIL GOURMET (TRANSPENNINE EXPRESS CONTRACT)

I write in relation to a resolution recently received from our Liverpool Branch in relation to a matter of serious concerning the planned engineering work due to take place on 2nd and 3rd November 2019 which will result in Liverpool Lime Street Station being closed.

We have been informed that staff, who will not be able to carry out their rostered duties during this period, have been instructed by their managers that they will have to sacrifice annual leave in order to supplement their “loss of earnings” or alternatively to lose a days’ pay. If they have no leave left to take then they have been told they lose a days’ pay.

We believe this instruction is completely unacceptable and no staff should be made to sacrifice pay or leave under circumstances which are completely out of their control such as this. This is a fundamentally unfair decision on Rail Gourmet’s part and we have demanded that this instruction is immediately withdrawn and they provide a guarantee that staff who were rostered to work will be paid normally and will not have to sacrifice any of their leave allocation.

The union’s NEC has considered this matter and made it clear that if they fail to withdraw this instruction then we will have no choice but to declare a dispute and will consider balloting affected members for industrial action.

We have made ourselves available to meet with the company to try to resolve this matter and have made clear the urgency of this issue due to the timescales involved.
