NON-PAYMENT OF LONDON LIVING WAGE, AGENCY STAFF – RAIL GOURMET (GWR CONTRACTS)

I am writing in relation to the above matter and concerning reports I have received regarding members being incorrectly paid.

It has been brought to my attention that many of our Rail Gourmet members working on Great Western Railway Contracts are being incorrectly paid for their work. It would appear that for a considerable amount of time Rail Gourmet has been sub-contracting to Quattro Agency and using agency staff to undertake Rail Gourmet work on Great Western Railway contracts.

Whilst the union would hope for all staff to be brought in house, at the very least, we would expect staff to be employed directly by the contractor, in this case by Rail Gourmet. Furthermore, it is extremely concerning that these individuals are being underpaid and instead of receiving the Foundation Living Wage of £10.55 per hour are currently receiving the National Living Wage of £7.83 per hour. This is unfortunately a historic issue and Quattro have been making these short payments for a considerable time.

Furthermore, I have reminded GWR that in 2014 a Breakdown in Industrial Relations dispute was resolved after an agreement to pay the Foundation Living Wage to contractors was reached between GWR and the union. Whilst I understand that GWR has not perpetrated this action directly, ultimately GWR must take responsibility as the client company for allowing this action to continue.

The National Executive Committee has considered this matter and instructed me to inform both Rail Gourmet and Great Western Railway that should this process not stop a dispute situation will exist between our organisations. I have informed both companies that the union expects our members to be paid the correct wage immediately and for any back payments to be made to staff.
