NON PAYMENT OF LONDON LIVING WAGE, AGENCY STAFF – RAIL GOURMET (GWR CONTRACT)

 

Further to my letter dated 18th December 2018 you will be aware that members on the GWR Rail Gourmet Contract, who had been employed via the Quattro Agency, were not being paid the correct rate of pay in line with the Foundation Living Wage. In 2014 it was agreed as part of the resolution to the Breakdown in Industrial Relations dispute with GWR that all contractors would be paid the in line FLW.

 

The lead officer took the matter up with Rail Gourmet and GWR and I am pleased to advise you that the affected members are now receiving the correct rate of pay. However the arrears payments remain outstanding so this issue is not yet resolved. The NEC has considered this matter and I have been instructed to advise both Rail Gourmet and GWR that unless the outstanding payments are paid 4th March 2019, a dispute situation will exist.

 

In addition to the above we have requested tripartite talks with Rail Gourmet and GWR with a view to reaching an agency worker agreement. The clear position set out by the union’s National Executive Committee is that any such agreement would bring to an end the use of exploitative contracts such as those using the Swedish Derogation which is a way of avoiding workers coming under the Agency Worker Regulations.
