PROPOSED CHANGES TO TERMS & CONDITIONS, DRIVERS – ARRIVA RAIL NORTH
I write with regards to the above matter and to inform you that Arriva Rail North has tabled a new deal for driver grades during recent negotiations with ASLEF. These discussions have been held without any involvement with the RMT despite your union being a cosignatory to the affected bargaining unit for driver grades.
The RMT believes that the company’s failure to consult and deliberately exclude us from negotiations is a breach of the Collective Bargaining Agreement. This situation not only shows a total disregard to a principled process but undermines recognised Trade Unions. The new deal has a significant impact on our driver members and could also have negative implications on other grades within the company.
Therefore, I have raised my grave concerns with Arriva Rail North and informed the company that unless these issues are satisfactorily resolved then a dispute situation will exist between our two organisations. I am also seeking legal advice over a breach of the Collective Bargaining Agreement and the company’s failure to consult with the RMT.
Having acknowledged the total disregard to the Collective Bargaining Agreement and the potential for a detrimental impact upon other grades, I have also referred this issue to the TUC for their review and I have written to the General Secretaries of the TSSA and Unite requesting an urgent meeting.
Additionally, I am making arrangements for a meeting to be held with the Lead Officer, Chair and Secretaries of each affected employee council, Senior Assistant General Secretary, Head of the union’s Legal department and members of the union’s National Executive Committee to discuss our next course of action.
