Dear Colleague

PROPOSED TUPE TRANSFER OF MERSEYRAIL SOFT SERVICES CONTRACT – MITIE LTD TO CHURCHILL CONTRACT SERVICES LTD

I write with regards to the above matter and to inform you that I have received a report from the Lead Officer, indicating that Mitie has lost this contract and that the contract has been awarded to Churchill Contract Services Ltd, from the 23rd June 2024. The Lead Officer reports that 35 employees will transfer under TUPE.

The matter has been subject to recent consideration by the union’s National Executive Committee who note the TUPE transfer of Merseyrail Soft Services Cleaning contract from Mitie to Churchills Group, after the abject failure of Merseyrail to take the contract in-house after RMT representations.

The Lead Officer has raised concerns about the potential removal of company sick pay for new employees post TUPE transfer, which is a detrimental step that the RMT opposes, and that there are also concerns about resolving the 2024 pay claim during the TUPE process. Therefore, the Executive Committee has instructed me to seek an updated report from the Lead Officer regarding these issues.

I trust this keeps you fully advised on the matter and I will, of course, update you on any further developments.

Yours sincerely

Michael Lynch
