RATES OF PAY AND CONDITIONS OF SERVICE 2020 - HITACHI RAIL LTD (BOUNDS GREEN, CRAIGENTINNY, DONCASTER AND LONDON NORTH POLE)

I can report that the union’s negotiating team has attended talks with the company and the following pay offer has been tabled:-

Annual Increase

· A 2.5% increase across the board to all pay grades and percentage related allowances.

Pay & Terms Disparities

Correcting the pay grades across the board is a complex and detailed piece of work which it is anticipated it would take longer than the 4-6 weeks that RMT would wish to have this resolved. The company is to commit to working on this, with RMT involvement, to having a structure in place applicable for all rates ready for introduction no later than April 21. The exception to this would be the overtime on the legacy contract which the company is committed to resolve by 31st August 2020.

Annual Leave

There is a variety of applications of annual leave and 3 styles of contracts in circulation. This means that the company has a large disparity that it has to address. This is causing both operational and engagement issues as staff at different locations receive vastly different entitlements, some of which are proportionality higher than the majority of staff employed by Hitachi Rail.

In regards to addressing the disparity from 19/20, the company will commit to honouring the gesture of goodwill payment to people on the older style contracts. This will mirror the approach that was previously taken for the annual leave year 2018/2019 and 2017/2018. This consists of a payment of up to 72 hours. This mainly applies to the team at Doncaster as they have worked to a 264 hours based holiday system and applies to approx. 45% of the total staff. North Pole staff was not pro-rated and therefore would not be in receipt of any payments.

The proposal by the business to move to a 2 tiered system would be based on a standardisation of entitlement based on the Contract of Employment. This was in order to bring more consistency across the board, as even without applying this, the issue of disparity across sites still exists. RMT has proposed we leave the annual leave entitlement as per the local practices which to clarify, would mean:

Doncaster

All staff take 264 hours annual leave. Team members on older style contracts (approx. 45% at this stage) would get a payment of up to 72 hours in April 2021.

North Pole

All staff benefit from 33 shifts of annual leave (approximately 50% are on new style contracts and therefore benefit from more annual leave that they or other people on the same contracts at different locations are entitled to)

Bounds Green, Craigentinny & Outstations

No change to the current arrangement of annualised hours and banked leave.

After careful consideration and having listened to the wishes of the union’s negotiating team, the union’s National Executive Committee has instructed me to inform the company of our rejection of their offer. Management has been informed of this decision and a meeting has been requested to seek an improved offer. Additionally, I have advised the company that a dispute situation now exists between our organisations.
