RATES OF PAY AND CONDITIONS OF SERVICE 2023 — HARSCO RAIL (STONEBLOWER CONTRACT)

Members will be aware that pay negotiations were outstanding at the time of the TUPE transfer of the Stoneblower Contract from Balfour Beatty to Harsco Rail.

While Harsco Rail has implemented an agreed pay rise for 2024, it is unacceptable to your union that Balfour Beatty has failed to honour former employees’ back pay for the period 1st January 2023 – 27th May 2023, prior to the TUPE transfer.

Despite the representations from your Union, Balfour Beatty have not changed their position, therefore the National Executive Committee have instructed me to seek a legal opinion on the company’s position and to write to Network Rail to raise this issue of the company’s intransigence and request that they intervene in this matter as it concerns their contractors.

Your representatives remain committed to resolving this matter, and I will keep you informed of any further developments.
