REMOVAL OF TRAVEL SAFE OFFICERS, STM CONTRACT – ARRIVA RAIL LONDON

A meeting has taken place to discuss the proposed removal of Travel Safe Officers on the Arriva Rail London network and whether TUPE will apply. The union has sought advice and guidance on the issue.

The Union’s National Executive Committee has considered the matter and taking into consideration the view of your representatives and the advice has instructed me to advise members to consider carrying out the following instructions:

If possible, accept the role with STM albeit under protest – be as flexible as possible in accepting a role.
If not working on the day of the transfer or with STM’s consent, turn up for work at Carlisle, you will likely be turned away – if so, just leave politely and do not make any fuss.
Remain in employment with STM until after the transfer.
Keep a record of all events and start putting together evidence if the role at STM cannot be accepted (however this is likely to mean that the employment terminates at the point of the transfer).

Furthermore, if you wish to pursue this matter through an employment tribunal then you will need to request legal assistance from the union once the TUPE transfer has taken place on 13 August 2021.

The Union will write to you again shortly after 13th August 2021, setting out the procedure that you need to follow to request legal assistance.
