RESTRUCTURING PROPOSALS, CARRIAGE CLEANERS - STADLER RAIL UK (MERSEYRAIL CONTRACT)
I write to update members on the developments relating to the above matter, with the company having indicated that they will be seeking to impose contracts with new terms and conditions (dismissed and reengaged) if members do not sign new contracts at individual consultations.
Members have already demonstrated their vehement opposition to the company’s proposal with a unanimous rejection in a referendum conducted on whether they should be accepted.
The company’s approach to seek members individual agreement to the new agreement with the threat of imposing the new terms and conditions is a disgusting tactic and demonstrates real contempt towards their staff. Members may be familiar with this approach from the news where it has been popularly termed ‘fire and rehire’ and popularly condemned.
Your National Executive Committee has considered a report from the lead officer on this matter and has stated in the strongest possible terms that the union will not tolerate the introduction of ‘fire and rehire’ into our industry without the strongest possible industrial response.
An urgent formal legal opinion on the matter is being sought and members should not sign any new contracts until such time as this legal advice is available.
The company have also been informed that we are now in dispute with them over this and that we are preparing to be ballot all members at Stadler Rail UK (Merseyrail Contract) in defence of our Carriage Cleaner Grade members.
