Dear Colleagues

Role of the Guard and Extension of DOO – South Western Railway

Further to previous correspondence last week, we informed you that the NEC has called further industrial action in this dispute. As a result of our legal obligations the industrial action relating to the restructuring agreements needed to be suspended for the duration of the strike called for 31st December 2017. For clarity we are writing to advise you that this industrial action will recommence from 00.01 hours on Monday 1st January 2018. Please see below for full details: -


1.    We instruct our Guards and Commercial Guard members to take industrial action from 00:01 hours Monday 1st January 2018 by refusing to work in accordance with sections 7.2.2, 7.2.4 and 7.4.2 of the Guards Restructuring Agreement.

GRA 7.2.4 RANGE OF MOVEMENT states as follows:

“A Guard shown spare within the roster can be allocated to cover work having a signing on time within 2 hours either side of the signing on time for which he/she was shown spare. Guards who are shown spare as rostered spare within the base roster will not be re-rostered to cover another spare turn. The movement arrangements for pre-booked work will remain.

There will be no demarcation between am and pm signing on times.”

•    On this basis Guards and Commercial Guard members are called upon to work only to the hours that are allocated on their base roster when they are spare and not to sign on for any time within 2 hours either side of the signing on time which appears on their base roster.

GRA 7.4.2 Allocation of re-issued diagrams states as follows:

“If a diagram assigned to a Guard has been re-issued due to minor alterations having been made, the re-issued diagram will be re-allocated to the Guard and he/she will automatically adopt the revised signing on time and diagram TOD. In such cases the original signing-on time may be moved two hours either side of the pre-booked signing-on time and the turn length may be extended by up to two hours.”

•    On this basis Guards and Commercial Guard members are called upon to only work the hours that are allocated on their local roster even in circumstances where a diagram is reissued and therefore not automatically adopt the revised signing on time and diagram Time of Duty if it has different hours to those that appear on their local roster.  

GRA 7.2.2 Maximum Cover Range states as follows:

“Guards shown spare within the base roster can be allocated turns having a longer time on duty up to a maximum of 11 hours, within the following ranges:

Rostered TOD                             Maximum Range of Cover
6hrs to 7hrs & 59 mins                 10 hours
8hrs & above                              11 hours

Guards rostered spare will only be allocated to cover work in accordance with the above cover ranges when the work is shown on the alteration sheets.”

•    On this basis Guards and Commercial Guard members are called upon to only work the hours that are allocated on their local roster and not work on any turns having a longer time on duty than is shown on the local roster.   

Note to Guard and Commercial Guard members

If your Turn of Duty is cancelled you become Spare and fall under the above clause GRA 7.2.4.

2.    Also we instruct our Driver members to take industrial action from 00:01 hours Monday 1st January 2018 by refusing to work in accordance with sections 7.2.4, 7.3.2 and 7.4.2 of the Drivers Restructuring Agreement

DRA 7.2.4 RANGE OF MOVEMENT states as follows:

“A Driver shown spare within the roster can be allocated to cover work having a signing on time within 2 hours either side of the signing on time for which he/she was shown spare for.
Driver who are shown as rostered spare within the base roster will not be re-rostered to cover another spare turn.”

•    On this basis Driver members are called upon to work only to the hours that are allocated on their base roster when they are spare and not to sign on for any time within 2 hours either side of the signing on time which appears on their base roster.

DRA 7.3.2 UTILISATION OF CANCELLED TURNS (PLANNED) states as follows:

“Turns cancelled in advance of the day on which the turn was planned to operate will be notified via the daily or weekly alteration sheet. A minimum of 36 hours notice will apply. The Driver previously assigned to the turn will be deemed as spare and may be utilised to cover other diagrams. In such cases the Driver's original signing on time may be moved +/- 2 hours either side of the pre booked signing on time for the turn and the turn length may be extended by up to 2 hours.”

•    On this basis Driver members who are deemed as spare in these circumstances will only work the hours that are allocated on their base roster and will not work any hours either side of the pre booked signing on time for the turn or any hours that extend the length of the term which are beyond those allocated on their base roster.

DRA 7.4.2 ALLOCATION OF RE-ISSUED DIAGRAMS

“If a diagram assigned to a Driver has been reissued due to minor alterations having been made, the re-issued diagram will be re-allocated to the Driver and he/she will automatically adopt the revised signing on time and diagram TOD. In such cases the original signing on time may be moved +/- 1 hour either side of the pre booked signing on time and the turn length may be extended by up to 1 hour.”

•    On this basis Driver members are called upon to only work the hours that are allocated on their local roster and if the circumstances described above apply not work on any turns which begin before the time they are due to sign on for or have a longer time on duty than is shown on the local roster.   

Note to all members
In any circumstances when your train is running late you do not stop the train and must complete your journey.
Once again I urge members to strongly support the above action and continue your support for your union in defence of the vital safety critical role of the guard and our campaign to stop the extension of DOO.
