ROLE OF THE GUARD AND EXTENSION OF DOO – SOUTH WESTERN RAILWAY

Further to previous correspondence I write to update you on the latest developments in our talks under the auspices of ACAS. Talks are progressing and SWR have requested we continue talks to discuss the operation of new trains and costs of keeping the Guard.

Having considered the situation, the NEC has instructed me to write to SWR informing them that the talks can continue on the following basis:

1. That they agree we can give 7 days’ notice of strike action in return we will not call any action while the talks continue. (Under new balloting regulations the normal notice period for industrial action is 14 days but this can be reduced to 7 days by mutual agreement.)
2. That they agree to provide our negotiation team with full details of their plans on the first day of these talks so a balanced view can taken on whether the company are being meaningful and open about the issues they have and why they cannot guarantee a 2nd safety critical person on all trains.
3. These further talks to start before or on Monday 11th June 2018.

The NEC believes we cannot afford the talks to drag on so we have suggested that the talks are conducted on continuous days until an agreement is made or either side believe that the talks are not moving towards a resolution to the dispute. SWR have been requested to confirm whether they agree or not to the above by Tuesday 5th June 2018. If no reply is received from the company by this date, the NEC will consider the matter again the same day.
