SAFETY CONCERNS – EAST MIDLANDS RAILWAY (EMR)

I have written to EMR management today about the safety concerns listed below. It is extremely disappointing and indeed impossible to comprehend why the company seems to be introducing unnecessary risk into the already dangerous working conditions of our members. I remind members that you have the right under law to refuse to undertake any work which you believe is unsafe and, in particular, the right to refuse to work in situations of serious and imminent danger, and to flag up potential hazards to your management. I will be calling a special National Executive Committee meeting tomorrow for 10.00 if our demands are not met by 17.00 today.

I have been absolutely inundated with complaints about the unwillingness of EMR to introduce some very basic safety measures. These include:

Refusal to mark vestibules as no waiting areas
Refusal to label seats not for use
Failure to reintroduce no commercial duties on train (as per the September revenue agreement)
Failure to protect staff despite raising concerns (St. Pancras)
EMR has scrapped reservations and no reservation only travel policy as per LNER, Avanti, etc.
EMR lifting ticket restrictions without any consultant or consideration of the impact of social distancing and safety on trains
Disciplinary dismissals
Clause 9 dismissals (two which I know of), despite the failure of employer to abide by its own procedures.

Unless I have a guarantee that these issues will be dealt with immediately, by 17.00 today I will be recommending that our National Executive Committee declares a dispute on these issues.
