SUSPENSION OF RMT REPRESENTATIVES, FRATTON
SOUTH WESTERN RAILWAY

Further to my letter of 22nd June 2020 members will be aware that we are balloting you and your colleagues over SWR’s unscrupulous targeting of RMT Company Council Representative Mark Gamble by taking disciplinary action against him on unscrupulous charges over alleged incidents that occurred outside of work. Regrettably we have just been informed that Brother Gamble has been dismissed by the company. An immediate appeal has been made to this appalling and unfair decision.

We have always been of the view that the disciplining of Mark was a thinly veiled attempt to target a hardworking and effective RMT representative. Management’s frankly reprehensible actions during the course of his disciplinary hearing only go to reinforce that this is a clear attack on your union, your reps and your lead officer. Incredibly they even made shameful insinuations of witness intimidation and accused witnesses who gave evidence in favour of Brother Gamble of lying.

The NEC has considered the report from our Lead officer and believes that predetermined is an understatement to describe this outcome. The weight of evidence and witnesses in support of our members’ innocence was compelling however, rather than give our member a fair hearing SWR chose to challenge the integrity of our Regional Organiser, RMT and ASLEF representatives. This clearly indicates to us that SWR dismissed Bro Gamble purely for his strength and ability to represent our members within the workplace.

We must therefore continue with the ballot and defend Brother Gamble. Papers will be sent out by post from the Independent Scrutineer Civica from Monday 29th June 2020 and must be returned by no later than the closing date of First Post Tuesday 21st July 2020. I urge all MB1, MB2 and MB3 grades on SWR to vote YES in favour of strike action and YES in favour of industrial action short of a strike in defence of your representative Bro Gamble. We cannot allow this disgraceful targeting of your rep to go unchallenged and the company needs to be sent a clear message that this will not be tolerated. Mark Gamble must be reinstated now!

In addition to the ballot we are also looking to give Mark full legal support starting with an interim relief claim on the basis that we believe he has been dismissed due to his trade union activities. I am also writing to the company to defend our unions’ integrity and that of your recently elected Regional Organiser.

As advised above the ballot opens on Monday 29th June 2020.
