TAX RELIEF, OFFSHORE CONTRUCTION SUPERVISOR - OFFSHORE DIVING INDUSTRY AGREEMENT

The following resolution has been submitted by our North East Shipping Branch:

“North East Shipping Branch calls upon the General Secretary and the National Executive Committee to utilise all resources available to initiate a campaign to highlight and address the following:-

Any and all companies not paying a certified ODIA Dive Supervisor working on the UKCS, the agreed rate, in line with the ODIA agreement.
To offer guidance and support in their struggle to claim SED tax relief if they are contracted as an Offshore Contraction Supervisor.
As a matter of urgency, we request that this campaign be actively initiated as soon as possible to resolve this issue on behalf of our members.

We understand that some employers, in the last couple of years, have moved some Dive Supervisors unto an Offshore Construction Supervisor contractor (OCS), at a lesser rate, but giving them an uplift when on a dive job as a Diving Supervisor. If the company are doing this, the individuals effected should be able to claim all the benefits of being an OCS, this included the ability to claim SED tax relief on any income comes under that role. This isn’t the case, HMRC and at least one ODIA signatory company, have informed the Dive Supervisors that they don’t qualify for that benefit. We believe that any ODIA signatory company and HMRC should not be able to pick and choose what benefits a Dive Supervisor has and should adhere to the guidelines laid out by HMRC.”

The union’s National Executive Committee has considered this matter and are cognisant of the complexities surrounding this issue. Consequently, the National Executive Committee has instructed me to convene a meeting with the ODIA Lead Officer and National Secretary present to discuss the way forward with this matter. This meeting has been scheduled for Thursday 2nd September 2021.

I will, of course, provide members with an update following the conclusion of this meeting.
