Our Ref: DLR/4/1
6th August 2024
Dear RMT Member,
THIRD PARTY DISMISSAL BY KAD
MMADUKA JOSHUA OBI, ISS (KAD CONTRACT)
The previous ballot last month returned a 100% yes vote in favour of taking industrial action but unfortunately did not meet the anti-trade union law thresholds. The National Executive Committee took the decision to conduct an immediate re-ballot and I strongly urge you to RETURN YOUR BALLOT PAPER immediately to make sure we are not prevented from acting on members wishes.
Your new ballot paper was posted to you yesterday so please look out for it arriving in the next few days. The closing date for the ballot is Thursday 22nd August 2024 so if you haven’t received your ballot paper by Monday 12th August, please contact us to be sent a replacement. You can call the RMT freephone helpline on 0800 376 3706 or e-mail info@rmt.org.uk
Brother Obi was singled out because of his work as an RMT Rep and both employers conspired to dismiss him after fifteen years of service to ISS and previous operators of the contract for KAD. This situation cannot go unchallenged, as it is a shocking abuse of power by management, targeting your valued colleague and hard-working representative. Now Mmaduka requires your support to show management that you stand together against unfair dismissal.
IMPORTANT NOTE ON BALLOT THRESHOLDS
Since the Trade Union Act 2016, where the government made the anti-trade union laws even more restrictive, all ballots have to reach two important thresholds in order for them to be valid.
- At least 50% of all eligible members must vote
- At least 40% of all those eligible to vote must vote Yes.
As a result of these draconian restrictions every single vote counts. A simple majority is no longer enough so you cannot rely on other colleagues to get the vote over the line. Therefore, I urge you to complete and return your voting paper as soon as you receive it
VOTE ‘YES’ FOR STRIKE ACTION
VOTE ‘YES’ FOR INDUSTRIAL ACTION SHORT OF STRIKE
Yours sincerely
Michael Lynch
General Secretary
