TUPE TRANSFER – FREIGHTLINER ENTITIES
Discussions have taken place with Freightliner Group who have advised your union of a legal entity rationalisation and associated TUPE Transfers, which will take effect from 7th July 2024.
The entity consolidation means the following:
- Members employed by UK Bulk Handling Services Ltd will TUPE Transfer to Freightliner Heavy Haul Ltd as of 7thJuly 2024, this affects RMT members working in the Viridor Waste from Energy Plant in Runcorn.
- Members employed by Freightliner Railports Ltd will TUPE transfer to Freightliner Ltd as of 7th July 2024, this affects RMT members working at the Bristol & Doncaster Railport Freight Facilities.
- Members employed by Freightliner Maintenance Ltd will TUPE transfer to Freightliner Heavy Haul as of 7th July 2024.
The Union can confirm there are no changes to members, jobs, roles, terms and conditions or union recognition, all collective agreements will also transfer. The company have stated that the TUPE Transfer should be considered a formal administrative TUPE.
The Union’s National Executive Committee has considered this matter and have noted. the company’s position that the matter should be seen as ‘administrative’. Furthermore, noting the report from the Lead Officer have acknowledged that there are no changes other than the employing entity.
Therefore, we will continue to monitor the situation and any updates will be placed back before the Union’s NEC for further consideration.
