TO ALL RMT MEMBERS ON THE INTERSERVE SOUTHERN CONTRACT

Dear Colleagues

TUPE TRANSFER, INTERSERVE SOUTHERN (GTR) CLEANING CONTRACT TO CHURCHILL SERVICE SOLUTIONS

Your union has just been informed that Interserve has lost the cleaning contract on Southern Railway with Churchill taking over the contract from Midnight on 30th June 2017. You and your colleagues will TUPE transfer across to the new company from that date and I wanted to write to members to reassure you about what this means.

What is TUPE?

TUPE (Transfer of Undertakings and Protection of Employment) is a legal process that protects workers when a company loses a contract and the staff transfer across with the work to a new employer. Under this process on 30th June 2017 you will begin working Churchill but you will remain on your current terms and conditions, keep your length of service and RMT will still be the Trade Union that represents you. The employers are required to consult with us as the recognised Trade Union for the affected workers to ensure the transfer is conducted in a proper manner. Please be assured your existing terms and conditions will be protected and could only be changed by agreement.

This latest development has been reported to the union’s National Executive Committee which has instructed me to contact Churchill to request an urgent meeting to discuss the transfer and their future plans for the contract. Churchill already has a contract with GTR for train cleaning. Rest assured RMT will continue to look after your interests throughout the TUPE process and into the future and we will carry on our campaign to improve your pay and conditions.
